Please read these Terms of Service before using EVRM (referred to in these Terms of Service as “EVRM," “us," “we," or “our").
Your access to and the use of our service is conditioned on the acceptance of and compliance with these terms. These Terms apply to anyone who uses or accesses our service.
Any account that is registered is required to be human and over the age of 18. The registrants must have a valid and legitimate email address with a strong password that maintains these accounts' security. You cannot use your account for any illegal or unauthorized purpose that will violate any law in any jurisdiction.
Purchasing either a monthly or yearly subscription, you agree to all necessary subscription fees at the then-current monthly/annual subscription rate, and you accept responsibility for all recurring charges until you cancel your subscription. We will send you yearly subscription renewal notifications approximately 1 (One) month before the expiry date. We will never save any of your credit card information. Hence, there will be no auto-renewal, and you have to pay the subscription fee before the expiry date. A valid credit card is required for these subscriptions, and if there are any issues with the renewal using a credit card, your subscription will be paused till further notice. If you have purchased multiple locations and any of your locations is disabled, you will only be charged for the active locations.
There are no refunds for the monthly and yearly subscription fees. Therefore, no cancellation of the subscription is available. Your account will remain active until your subscription expires. Expiration of your account may result in the deactivation or deletion of your account and the removal of all content in your account. This information may be restored by request of the registered email to us within 30 days. There is no recovery of data from any canceled accounts. We may retain residual account information in our backup and/or archival copies of our database. A reasonable effort will be made to delete your information as soon as possible after communicating your intention to us.
A valid credit card is required for paying accounts. Trial accounts are not required to provide a credit card number. All invoicing is in advance and in accordance with our pricing schedule. We will not proffer any refunds or credits for partial months of service, annual payments, or months unused with an open account. No exceptions will be made to provide fairness to all.
Subscription fees are exclusive of all taxes, levies, or duties imposed by taxing authorities. You will be responsible for the payment of all such taxes, levies, or duties, excluding Australian goods and services taxes. You will be liable for the payment of all these taxes.
You hereby agree that we may, in to exercise our sole discretion, remove or delete any data, accounts, or other content that violates these Terms of Service or otherwise objectionable.
We reserve the right to terminate any trial accounts without a payment method fourteen (14) days after expiration.
At our sole discretion, we have the right to suspend or terminate your account if you breach these Terms of Service. Any termination of your account will result in the deactivation or deletion of your account, denied access to your account, and the removal of all content in your account.
We reserve the right at any time and from time to time to modify or discontinue, temporarily or permanently, the EVRM Service (or any part thereof) with or without notice. However, we will make our very best efforts to notify customers of any upcoming system maintenance and/or service disruptions.
Prices of all our Service plans are subject to change. If we, for any reason, have to remove the plan you are on or require an upgrade to a current plan; we will provide you with sufficient notice via email.
Any content that is yours remains yours. These Terms of Service do not grant us any licenses or rights to your content except for the limited rights needed for us to provide our service to you.
Our service contents are copyrighted under the Australian copyright laws, and no part may be used without our express written permission. You may not reproduce or exploit any portion of the content without express written permission. The use of our service does not pass any rights or ownership to you.
It may be necessary for our staff to access your account and content to resolve any issues. When you contact our team, it is implied that you are allowing our staff to access your account to resolve any problems.
You agree to indemnify and hold its parents, subsidiaries, affiliates, officers, partners, and employees from any claim or demand, including reasonable legal fees, made by any third party due to or arising out of your use of our service, use of your account by any third party, your violation of these Terms of Service, or any infringement by you or any third party using your account.
The software and its contents are provided “as is" and “as available" without any warranty or representations of any kind, whether express or implied. No oral advice or written information given by us or any of our affiliates, employees, officers, directors, agents, or the like will create a warranty. Price and availability information is subject to change without notice.
We will not be liable for any indirect, incidental, special, exemplary, or consequential damages, lost revenue, lost data, or business interruption, in any way whatsoever arising out of the use of, or inability to use, our service.
